DATE: 10/12/2024 | TIME: 15:33 PST | INCIDENT: OFFICER INVOLVED SHOOTING | WEAPONS INVLOVED: YES | DEATHS/INJURIES: ONE DEAD, ONE INJURED
I, Timmothy Robinson, 5K-157, was on a ride-along with my patrol partner, Jay Powers, 5k-381, who was operating LiDar equipment on both the north and southbound traffic of Interstates 2/4. While doing so, we received an assistance call regarding a suspect who might evade law enforcement. We responded to the call as Union 12 and proceeded code 2 to the location of the traffic stop at 360 Interstate 4 southbound. During our commute, 5K-153 alerted us that the suspect threw a baggie at them. Upon arrival, we waited in our patrol vehicle for further instructions. However, while waiting, the suspect took off south on Interstate 4.
During the pursuit, the suspect drove very recklessly, including but not limited to driving in opposite lanes, speeding, weaving in and out of lanes, and driving through a truck stop/gas station. Soon after entering the city limits, spike strips were set and popped most of the suspect's tires. He took a slight right onto a transfer ramp that moved him to Long Beach Freeway, where he disconnected his trailer and continued onto the city roads. From there, he went into the oil fields and turned back heading toward Los Angeles. He took a sudden left on Orchardville Ave and crashed into a brick wall.
After exiting his truck with a shotgun in hand, the individual ran towards a factory building, posing a threat to the public and factory employees. I grabbed my shotgun from my patrol vehicle and pursued him. I aimed my shotgun and fired a round, hitting him in the lower back, and causing him to fall forward. He got back up and entered the factory as I fired another round, missing him. Upon entering, he pointed his weapon at the door and shot me in the chest. I returned fire, hitting him in the upper chest/left shoulder and left arm/head. Other officers then apprehended the suspect while I received self-first aid with the help of a LASD officer. After treating myself, I called for a CHP supervisor, and 3K-100 responded and cleared me.
In total, I discharged four shotgun rounds of 12 Gauge 00 buckshot, with three striking the suspect, and one missing hitting a metal garage door. The suspect was confirmed dead with head, and chest injuries and major blood loss.
The reason for discharging the weapon was that the suspect was running into an operational factory where there could have been civilians or employees. Due to this, I had reasonable cause to ensure the safety of those who might have been inside and threatened by the suspect. Referring to the case of Tennessee v. Garner, "Under the Fourth Amendment of the U.S. Constitution, a police officer may use deadly force to prevent the escape of a fleeing suspect only if the officer has a good-faith belief that the suspect poses a significant threat of death or serious physical injury to the officer or others." I used my shotgun to stop the suspect from causing further harm to others who may be inside the factory.
