Being rear-ended at a stop sign is a good example. For other cases it may be difficult to determine if a case is something that you should pursue. Falling at a store or another's property might prove to be difficult in determining who is to actually to blame for the injury.

Issues like comparative negligence, can divide fault between two parties. Under Florida law, fault is not necessarily black or white. It can be divided up by percentage and each person is responsible for their own percentage of fault. It is found in many car accident cases where an actual jury can make the determination that it was 30% of one party's fault and 70% for the other.

Other types of cases where comparative negligence is commonly found is in premise liability cases, where someone slips and falls. For example, if someone trips in Walmart, one might assume that it is easy to say that it is 50% of the store's fault due to something being left in the aisle and the other 50% of the customer's fault because of him or her not paying attention to the structure.
