Tracking the Status of your case with USCIS:

EB1 - FIRST PREFERENCE
This is for foreign nationals with extraordinary ability in their field (EB-1A), outstanding professors or researchers (EB-1B), or certain multinational executives or managers (EB-1C). Beneficiaries in this group are allotted 28.6% of the available 140,000 annual green cards, plus any green cards that are not required by the fourth and fifth preference groups, EB-4 and EB-5 respectively.

EB2 - SECOND PREFERENCE
This is for foreign nationals who are members of professions with an advanced degree (Masters, PhD) or have the equivalent of at least 5 years of progressive work experience beyond the baccalaureate degree. The EB2 is also for foreign nationals with exceptional ability.

The EB2 second preference has a unique sub-category called the EB2-National Interest Waiver (EB2-NIW). This sub-category is for foreign nationals who do not want to go through the labor certification process. To be eligible to apply for a Green Card under the EB2-NIW category you will need to demonstrate that your work will be beneficial to the United States, and you must meet specific sets of criteria set forth by USCIS, that indeed justify why the labor certification process should be waived.

Beneficiaries in the EB-2 group are allotted 28.6% of the available 140,000 annual green cards, plus any green cards that are not required by the first preference group, EB-1.

EB3 - THIRD PREFERENCE
EB3 green card category is divided into 3 sub-categories according to the level of training or education required to perform the job which are: unskilled workers, skilled workers, and professionals.

Unskilled workers (also categorized as other workers) perform jobs that require less than 2 years of training or experience, while skilled workers are for persons whose jobs require at least 2 years of work experience.

Professionals on the other hand, are for individuals whose jobs require at least a bachelor's degree to perform.

Beneficiaries in the EB-3 group are allotted 28.6% of the available 140,000 annual green cards, plus any green cards that are not required by the first and second preference group, EB-1 and Eb-2 respectively. Furthermore, no more than 10,000 green cards may be allotted to member who fall under the "other workers" subcategory of the EB-3.

EXCEPTIONS
First, with the exception of the EB1 through extraordinary ability AND EB2-NIW all other EB categories require a US employer to file a petition with USCIS on behalf of the foreign national beneficiary.

Second, with the exception of the EB1 category and the EB2-NIW subcategory, all other EB categories require a US employer to first file a labor condition application with the US department of labor before filing a petition for an alien worker with USCIS.
